About Kathryn
Kathryn McCarthy is a member of the global leadership team and leads Managed Document Review and Analytic Research within the Technology segment, one of the segment’s largest practices. With more than 25 years of experience in the legal industry, Ms. McCarthy has specialized expertise in Hart-Scott-Rodino Second Requests, antitrust investigations and e-discovery processes. She has managed e-discovery responses for more than 50 Second Requests, and has been instrumental in establishing FTI Technology’s position as the go-to provider in approximately 30% of all Second Requests in the United States.
Ms. McCarthy has a long track record of introducing new and innovative technology and services, including the transformation of the managed document review offering to a secure, cost-effective and flexible virtual solution, in addition to expansion into Canada, continental Europe, China, Japan, Brazil and Australia. She is expert at aligning client needs with market trends and service delivery models, and has been a key contributor to FTI Technology’s ongoing growth, including double-digit, organic, year-over-year growth between 2017 and 2023. This growth has created a footprint to handle the most complex client needs with the same expertise anywhere across the globe.
As an expert in optimizing e-discovery software, workflow and legal professionals to ensure excellence in delivery for clients, Ms. McCarthy has handled the entire e-discovery process on behalf of global companies in financial services, pharmaceuticals, high tech and manufacturing. She has helped clients negotiate scope, document review parameters and production requirements for dozens of investigations and merger clearance reviews.
Prior to joining FTI Consulting, Ms. McCarthy held the position of Counsel at Simpson Thacher & Bartlett. Her responsibilities included maximizing efficiencies in the handling of substantial discovery projects. She routinely negotiated and implemented e-discovery protocols with both governmental agencies and private parties. She supervised all aspects of the e-discovery process on behalf of clients, from legal holds and data retrieval to managing and monitoring productivity and accuracy of review attorneys operating under extremely tight deadlines.
Ms. McCarthy speaks regularly on various topics related to antitrust and e-discovery.
Relevant Experience:
- Served as the key contact for a pharmaceutical company facing numerous, complex, multijurisdictional merger clearance reviews; oversaw FTI Technology’s approach and execution for the subsequent investigations and acted as a trusted advisor to the client throughout
- Led an antitrust engagement, negotiating the discovery protocols with the government and working closely with clients to identify relevant data and develop and manage the discovery budget and workflows, including the foreign language review conducted in Asia
- Managed global e-discovery investigations in response to U.S. Securities and Exchange Commission and Foreign Corrupt Practices Act matters, requiring an in-depth understanding of data privacy laws and practical knowledge for coordinating the appropriate technology, staff and budget to respond in compliance to these laws
